Responsibilities Of Building Owners

Building owners carry both statutory and contractual duties around ventilation hygiene. Here is what those duties look like in practice.

Statutory duties

  • Regulatory Reform (Fire Safety) Order 2005 – Responsible Person duties
  • Workplace (Health, Safety and Welfare) Regulations 1992 – effective ventilation
  • Health and Safety at Work etc. Act 1974 – general duty of care

Contractual duties

  • Insurance policy conditions on internal cleanliness and kitchen extract
  • Lease covenants requiring maintenance to industry standards
  • Service-charge transparency obligations to tenants
  • Pre-letting, sale and dilapidations evidence expectations

Discharging the duty

Building owners typically discharge these duties through the Facilities or Estates function, with a competent compliance partner delivering inspection, hygiene management and reporting against a recognised standard – most commonly TR19.
